Emergency Temporary Order Governing Certification for Orange County Process Servers

Orange County, FL — The efforts of many throughout the entire State of Florida has taken a turn for the better. Today, Orange County, Florida Chief Judge Frederick J. Lauten entered an 2014-23 – Emergency Temporary Order Governing Special Process Servers which extends the appointment for those process servers whose licenses were set to expire tomorrow September 30, 2014. This is fantastic news, and a huge relief for legal community in and around the entire State of Florida.

On August 18, 2014, Orange County Sheriff Jerry Demings sent a certified letter 20140818 Letter from Sheriff Jerry Demings to all licensed process servers in Orange County, Florida notifying them that the Orange County Sheriff’s Office special process server program will conclude by the end of this year.  What the letter did not disclose was more than half the licenses of the special process servers in Orange County that were set to expire on September 30, 2014 would not be renewed. Florida law permits Sheriff’s in each county to operate a special process server program, but relatively few do. Of the 67 counties in the state of Florida, 12 are Sheriff appointed, 38 are Court appointed, 4 are both Sheriff & Court appointed, and 13 require a Motion & Order. With the high volume of process served in Orange County, this information prompted immediate action by many from the legal community in and around the State of Florida.
