Florida cases may soon require an order to appoint process server in Orange County

Orlando, Florida — On August 18, 2014, Orange County Sheriff Jerry Demings sent a certified letter 20140818 Letter from Sheriff Jerry Demings to all licensed process servers in Orange County, Florida notifying them that the Orange County Sheriff’s Office special process server program will conclude by the end of this year. Florida law permits Sheriff’s in each county to operate a special process server program, but relatively few do. Of the 67 counties in the state of Florida, 12 are Sheriff appointed, 38 are Court appointed, 4 are both Sheriff & Court appointed, and 13 require a Motion & Order. Through a simple motion, an attorney may have a private process server designated for a case.

Currently, approximately half of the process servers licenses in Orange County are set to expire on September 30, 2104. The other half are not set to expire until March 31, 2015; however, due to the recent changes those process servers licenses expiring on March 31, 2015 will actually be null and void after December 31, 2014. What does this mean to you? If you have process being served in Orange County, Florida, a Motion & Order to appoint process server may be required as early as October 1, 2014. If you are serving Federal Process, Subpoena’s, Landlord to Tenant Notices, or any other General Correspondence, a Motion & Order to appoint process server is NOT required.
